Mead Johnson, Maker of Enfamil, Loses Multi-Million Dollar False Advertising Case Against Store-Bran

GORDONSVILLE, VA., December 2 , 2009PBM Products, LLC, a leading infant formula company that supplies store-brand infant formulas to Walmart, Sam's Club, Target, Kroger, Walgreens, and other retailers, has received a favorable jury verdict and a $13.5 million damages award in its false advertising lawsuit against Mead Johnson & Co., the operating subsidiary of Mead Johnson Nutrition Company (NYSE: MJN) (“Mead Johnson”), the makers of the national-brand Enfamil® LIPIL® Infant Formula. Mead Johnson is 83 percent-owned by Bristol-Myers Squibb.



PBM’s lawsuit claimed that Mead Johnson engaged in false and misleading campaigns against PBM’s competing store-brand of infant formulas, suggesting they do not provide the same nutrition as Mead Johnson’s brands. PBM’s store-brand infant formulas cost up to 50 percent less than Enfamil® LIPIL®. The $13.5 million in damages awarded by the jury in the United States District Court for the Eastern District of Virginia is one of the largest damages awards ever for a false advertising case.



“This decision by a jury of the people confirms that Mead Johnson’s ads have been false in suggesting that there is a nutritional difference between our store-brand formula products and their products, when in fact the only major difference is price,” said PBM CEO Paul B. Manning. “Despite Mead Johnson’s scare tactics, parents are assured that PBM’s formula products are as high quality and nutritious as Mead Johnson’s.”



U.S. District Court Judge James R. Spencer issued his written rulings yesterday following the November 10th jury verdict. Judge Spencer’s written rulings permanently enjoined Mead Johnson from making any false statements concerning PBM's infant formula, including the claims Mead Johnson previously made in Enfamil advertising that "It may be tempting to try a less expensive store brand, but only Enfamil LIPIL is clinically proven to improve brain and eye development," and "there are plenty of other ways to save on baby expenses without cutting back on nutrition." The Court also ordered Mead Johnson to retrieve from the public domain all advertising or promotional materials containing these or any other false claims about PBM's store brand infant formula.

The nutritional supplements under examination in the case are two fats, DHA (docosahexaenoic acid) and ARA (arachidonic acid), which Mead Johnson calls “LIPIL®” solely for marketing purposes and touts as promoting infant brain and eye development. PBM’s claim focused on Mead Johnson’s direct mailing to more than 1.6 million parents of an alarming blurry picture of a child’s cartoon duck next to a clear picture of the same image which suggested that anything other than the Enfamil LIPIL® blend of ingredients is inferior and will result in poor eye and brain development. Other parts of the false advertising campaign consist of statements that only Enfamil LIPIL has been proven to confer visual and mental benefits on infants, and store-brand formulas are a “cut-back in nutrition” compared to Enfamil.



PBM successfully argued that these advertisements were false and misleading especially since PBM store- brand infant formulas have the same nutrients at the same levels as Enfamil. PBM infant formulas are formulated to contain DHA and ARA, and are sourced from the same supplier in amounts which equal or exceed the DHA and ARA in Mead Johnson’s Enfamil LIPIL®.



This decision marks the third time PBM Products has sued Mead Johnson for false advertising claims. On the prior occasions Mead Johnson admitted that it made false claims about PBM’s products. It is also the first false advertising case to focus on the issue of DHA and ARA nutritional ingredients in formula, which were introduced into the market in 2003 and have become a staple in recent years by many brands as key components for infant development.



“This jury verdict should send a significant and clear message to Mead Johnson about the way it conducts marketing and advertising for its brands,” said Manning. “This lawsuit also demonstrates our complete commitment to defending our products and the valuable brands of our retail partners.”



“As a parent and supporter of children’s medical research, I take a personal responsibility in assuring our customers that the products we produce are healthy and nutritionally equivalent to brand names like Enfamil® LIPIL®. It is important, especially now, for parents to know that there are lower priced yet highly nutritious store-brand formulas that will provide the same benefit to their children as any national brand name formula product,” Manning added.



The U.S. infant formula market is estimated at $3.4 billion and the global market is estimated at $7.9 billion.

Chrismas is knocking at the door. Unlike last year, this year my eldest daughter can make a wish list for Santa. The list is including the “Four Musketeer” Barbie dolls. Do you serve breakfast in the morning? If you see in the movie, you can always see how nicely they prepare the breakfast in the table. It is totally different from my breakfast table. Every morning, it's always a big mess.

Quilted Metal Hot Pad

Do you like to recycle? Then I think this is a perfect project for you. All you need is: soda cans, fat quarters of yellow and green cotton fabric, scrap of cotton batting, fusible web, press cloth and basic sewing supplies

Note: Use heavy-duty craft scissors for metal--not your sewing scissors! I also recommend wearing protective gloves when cutting metal.

Carefully cut apart three soda cans, removing the top and bottom sections. Press fusible web to the back of the metal pieces using a press cloth to protect the painted surface of the soda can.

Cut nine 2 inch squares from the fused metal. Remove the paper backing from the fusible web and center the metal pieces right side up on top of an 8-inch square of cotton fabric. Press using a press cloth to protect the painted surface.

Cut four 1 1/2 x 8-inch strips of green fabric. Turn under 3/8 inch along both edges and press down the entire 8-length. Lay two of the strips across the width of the fabric square, covering the edges of the metal squares. Pin the fabric strip to the fabric backing. Stitch down either side of the fabric strip through all layers of fabric and the metal squares. Repeat, stitching the remaining two strips vertically. Note: Be careful to not pin through the metal squares.

Cut four 1 1/2 x 10-inch strips of yellow fabric. With right sides together, stitch two of the strips of fabric to the sides of the metal fabric layer (hot-pad top layer) using a 1/4-inch seam. Press the fabric strip out from the edges of the hot pad top. Trim the strips even with the hot-pad top. Repeat stitching the remaining two strips to the opposite sides of the hot-pad top.

Cut four 1 1/2 x 10-inch strips of lime green fabric. With right sides together, stitch two of the strips of fabric to the sides of the hot pad using a 1/4-inch seam. Press the fabric strip out from the edges of the hot-pad top. Trim the strips even with the hot-pad top. Repeat stitching the remaining two strips to the opposite sides of the hot-pad top.

Measure the hot-pad top and cut two squares, one from the yellow fabric and the other from cotton batting. Lay the yellow square of fabric right side up on a flat surface; place the metal fabric layer on top, right sides down. Top with the cotton batting square. Pin together, being careful not to pin through the metal squares. Stitch around all sides using a 1/4-inch seam and leaving a 3-inch opening along one side. Turn right side out and hand-stitch the opening closed.

Quilt the layers together by stitching around the borders and down the centers of the green strips of fabric. Remove any stray threads and press the hot pad using a press cloth.

Needlework Set

I found this wonderful needlework set in the internet with the instruction how to make it. It said only takes 4 hour to make (although probably more than 4 hours for me to make). I think this is a wonderful gift to give to somebody that like to sew or to quilt. It's pretty and and not long to make. I want to make this if I have time.

Simple Dolly

What about if your daughter asks you to make dolly or teddy bear and you just learn how to sew? No need to worry, I just found the solution. You just went to the fabric store and buy fabric with dolly or teddy bear prints on it. Cut the the outline of the dolly or teddy bear, stitch it and put some stuffing and you are done! It’s super easy.

 

3 Hours Later....

My husband has a friend that he hasn’t met up with since last year. Last weekend they finally got the opportunity to meet and catch up on news. To my husbands surprise it seems that his friend got divorced with his wife. Then the most shocking news is that he proposed to his divorce lawyer just 3 hours after the divorce.

My New Hobby

I have a new hobby. Can you guess? Yup! It’s sewing. I did some simple patchwork recently and it’s addictive. I am not very expert in using sewing machine. Somehow I can’t sew in a straight line. So, at this moment, I just hand sew all the pieces together. One thing bothered me, though. I hate threaded the thread into the needle. It took me sometime to do it. Blame it to my old eyes.

Fat Quarter

If you are a quilter, you may already be familiar with this term and the benefits of using fat quarters. However, if you're unfamiliar with quilting, you may not know how much fabric you need when you see "fat quarter" listed in a project's materials list.

When you purchase fabric off a bolt, it is generally folded in half with the selvage edges matching. A 1/4 yard cut of fabric is a 9-inch-wide strip cut across the width of the fabric (usually 44 inches wide, for cotton quilting fabrics). A 1/4 yard cut typically measures 9 x 44 inches. A fat quarter of fabric is made by cutting an 18-inch-wide strip across the width of the fabric, and then cutting the strip in half again, but this time along the fold to yield two fat quarter pieces, each 18 x 22 inches.

Depending on what you're making, it might be more advantageous to purchase fat quarters, rather than traditional yardage cuts for your project. Some benefits of fat quarters include:

The ability to cut pieces up to 18 inches long, rather than only 9 inches long
Fat quarters are often packaged together with coordinates from the same fabric line, making it easy to select a group of fabrics that go with each other.

 

Stay At Home Mom

Get yourself couple of pocket calendars. They have wide selection with attractive price. List all the things you want to do. Cross out when you have done them. You will get a sense of accomplishment.

Start A Playgroup

Post ads in your local paper and also online. You can also chat with your friends from the park about bringing their kids over for a few playdates. You would be in charge of everything. This way you'll have your sense of accomplishment back because you have once again proven that you can organize more than just a refrigerator.

When the pillow covering becomes worn out, you can replace the outer pillow cover only and reuse the old pillow form, making it inexpensive to freshen up your decor.
To make a basic pillow cover, follow the steps below:

- Measure the pillow form in both directions and cut two pieces of fabric 1 inch larger than the form in each direction to allow for 1/2 inch seam allowances all around. For example, for a 12 x 16 inch pillow form, cut two rectangles of fabric 13 x 17 inches.
- Pin the fabric rectangles right sides together and stitch 1/2 inch from the raw edges all around, leaving an opening on one side for turning and inserting the pillow form.
- Trim the seam allowances to 1/4 inch all around and clip across the corners. Turn the pillow cover right side out and press.
- Insert the pillow form and slipstitch the opening closed.

 

Time for Vacation

I was only 15 years old when my parents brought me and my brother (he was only 7 years old then) to Hong Kong for vacation. It was our first trip overseas. I was very exciting as I had heard about Hong Kong many times from books and TV. It was an exciting trip and I really had a wonderful time there. My husband, on the other hand, has never been to Hong Kong before, so probably Taiwan is our next holiday trip. The next question is: should we bring the children? I guess it depends whether my in laws are willing to take care my children. If they don’t then we have to bring them along. Since you also can find Disneyland in Hong Kong, I guess our children will have a great time.

Potty Training

It seems like just yesterday that I changed my toddler's first diaper, and now I am wondering if it's time to start potty training. There's no magic age at which children are ready to start learning how to use the potty, but some develop the necessary physical and cognitive skills between 18 and 24 months of age. Many parents don't start potty training until their children are 2 1/2 to 3 years old, when daytime bladder control has become more reliable. And some children aren't interested in potty training until they're closer to 3, or even 4.

Use the checklist below to measure your toddler's progress toward readiness, and keep in mind that starting before your child is truly ready doesn't mean you'll finish sooner — it's more likely that the process will just end up taking longer.

You don't have to wait until you've checked off every item to start training. Just look for a general trend toward independence and an understanding of what it means to go to the bathroom like a grown-up.

Physical signs
Is coordinated enough to walk, and even run, steadily.
Urinates a fair amount at one time.
Has regular, well-formed bowel movements at relatively predictable times.
Has "dry" periods of at least three or four hours, which shows that his bladder muscles are developed enough to hold urine.

Behavioral signs
Can sit down quietly in one position for two to five minutes.
Can pull his pants up and down.
Dislikes the feeling of wearing a wet or dirty diaper.
Shows interest in others' bathroom habits (wants to watch you go to the bathroom or wear underwear).
Gives a physical or verbal sign when he's having a bowel movement such as grunting, squatting, or telling you.
Demonstrates a desire for independence.
Takes pride in his accomplishments.
Isn't resistant to learning to use the toilet.
Is in a generally cooperative stage, not a negative or contrary one.

Cognitive signs
Can follow simple instructions, such as "go get the toy."
Understands the value of putting things where they belong.
Has words for urine and stool.
Understands the physical signals that mean he has to go and can tell you before it happens or even hold it until he has time to get to the potty.

 

TV Can Be Good For Children

Where kids are concerned, TV and movies get a bad rap, but with healthy viewing habits and parental supervision, “screen time” can be a positive experience for children. For one thing TV can help kids learn about a variety of subjects. If there’s a subject your child enjoys, more likely than not, there is a TV show, movie, or educational DVD that explores the subject in detail. You might be even be surprised to find out how many kids watch and love educational shows aimed at adults. Most kids are not able to visit the rain forest or see a giraffe in the wild, but many have seen these things on TV. Thankfully, educationally minded producers have given us many shows and movies that allow viewers to see amazing footage of nature, animals, society, and other peoples. Kids and adults alike can learn from this type of media and gain a greater appreciation for our world and the animals and other people who inhabit it.

How do I answer my toddler's questions about genitals?

As parents, we can get anxious when children ask about anything remotely sexual. But your child's curiosity about genitals is no different than her questions about eyes, ears, feet, noses, and other less private parts. And genitals are pretty interesting, as body parts go. Her questions are only natural — after all, she has to learn about private parts from someone, and it's best for that someone to be you.

How should you respond? Be direct, and stay matter-of-fact. Follow the rule of thumb: "Is this how I would tell her about elbows or knees?" Give her the anatomically correct name for the body part and avoid baby talk — using funny or silly words will just confuse her and, if anything, makes the discussion a bigger deal. If she asks what they're for, you can say that genitals are for going to the bathroom. If you feel comfortable mentioning that they're also used for making babies, that's okay, too. She may not get it, but a child this age has no understanding of sex and won't make that connection.

She may also ask why Daddy's or her brother's genitals are different from hers. Point out that each person is unique: Her best friend's eyes are blue while hers are brown, and Grandma's nose is smaller than Grandpa's. In the same vein, boys' private parts look different from girls'. Keep it simple, and if you don't act embarrassed, she won't be, either.

High School Reunion

I had a high school reunion last week, but unfortunately I could not attend it as I am living in another country now with 2 young children to care for and believe me travelling with 2 children is not easy (not to mention paying for the extra flight tickets).

Although I could not attend the reunion but I was still able to look at the photos of the event in the internet (how I love internet). It was fun to see all the familiar faces of my high school colleagues. Some are fatter and older (especially the men). However, most of the ladies haven’t changed much over the years. I guess, all that skin care does work.

Anyway, I saw the current pictures of some of my high school teachers also that attended the reunion. I was happy to see that my favorite teacher was there. He was my inspiration to become a better person. He was a dedicated teacher and always had time for all of us whenever we had questions.

How to protect your family from swine flu

Up to today my 14-month-old toddler still hasn't talk yet. I heard that Rhymes, jingles, and silly songs are big hits with toddlers. If your 14-month-old is already speaking several words, encourage her willingness to repeat after you by singing silly or repetitive songs, such as "Twinkle, Twinkle Little Star." As she becomes familiar with the refrains she'll chime in one word at a time and before you know it she'll be singing the whole song right along with you.

My Baby is 14 Month Old

Observe a group of 14-month-olds at the park and you'll note that they're basically loners. Socializing isn't really toddlers' thing, and at this age a child is unlikely to do anything more than engage in parallel play, during which he/she and his/her companions play side by side but don't interact — unless it's to grab whatever object another child is playing with. My Baby is 1 Year Old

Though at this point my youngest daughter’s vocabulary probably consists of only a couple of words, she can babble in what sounds like short sentences, complete with vocal inflections. It's almost as if she's speaking a foreign language.

How to Handle Public Tantrums

The best thing you can do is stay calm. Unlike that kicking, screaming child in your shopping cart, you have the ability to control your emotions and restore the peace.


You can't bring your toddler to his senses by raising your voice or making threats. Getting mad will only escalate his emotions. You don't want to cave in, either. If your child is screaming because you passed up the candy aisle, don't make a U-turn just to calm him down.


Instead, tell him firmly that he has to stop throwing a fit. If he keeps it up, it's time to use your most potent weapon: the exit door. Even if you're in the middle of a big shopping trip, you can always whisk your child out of the store. Children like to shop, and there's a good chance he'll calm down once he understands the consequences. If he continues throwing a fit, take him home, if possible. The shopping can probably wait.


Keep in mind that children are more likely to lose their tempers when they're hungry or tired. If you're about to embark on a marathon shopping trip, try to make sure your child is tanked up and well-rested. It's also a good idea to establish the ground rules before you reach the store. If he's likely to lobby for a new toy, you can explain ahead of time that you're only there to buy groceries.


Frustration is also a big tantrum-producer. If you know your child is going to insist on visiting the pet store when you go to the mall, make sure you have time to do it or think twice about the trip. Thinking through his probable reactions, the consequences, and the alternatives isn't really "giving in" to him, it's being a wise parent.


Because he's out of control, a tantrum can be scary for a child. Once it subsides, give your toddler hugs and reassurance. It's fine to acknowledge his feelings. You might try to make leaving less painful by offering to read a favorite story when you get home.


Keep in mind that your child's tantrum is nobody's business but yours. Your toddler will have tantrums, and some of them are bound to happen in public. It doesn't mean you're a bad parent, only that you're the parent of a toddler.


If you handle the situation with calm and grace, expect to see a lot of knowing glances and sympathetic smiles. Regardless of any looks you get, remember that your child doesn't understand your embarrassment. Public tantrums aren't meant to humiliate parents, so you should treat your child the same way as if the tantrum happened at home.

Do Babies Need Discipline?

You bet. Not as in punishment, which babies don't understand, but using another definition of the word: "training that corrects, molds, or perfects," according to Merriam-Webster.

You may have noticed your baby increasingly "tests" what he can do and how things work. This is how older babies and toddlers learn about the world around them. It's your job to set some limits on that exploration to keep your baby within the bounds of what is acceptable and safe.
It helps, though, not to overdo it on the rules. One way to decrease the number of limits you'll need to set is to provide fewer opportunities for your baby to get into trouble. Babyproof (and later toddler-proof) your home so that it's a "yes" environment to play in rather than one full of no-nos. If you wind up saying "no" a lot, your baby may become desensitized to it and start to tune it out altogether.

Use simple language when you communicate a rule: "Hot." "Not safe." Let your tone of voice — firm, not frightening — help convey your message.

Whenever possible, make an effort to redirect his attention to something more acceptable. Be prepared for it to take many times for your baby to stop testing a particular limit. Babies learn through repetition and practice. Parents survive this phase through patience.
